Terms & Conditions

By placing a booking, you "The Client" acknowledge that you have read and agreed to these terms and conditions with Kasa Photobooth "The Owner".

  1. AGREEMENT:
    This agreement shall be between “the client” and KASA Photo Booth herein referred to as “the owner” located in Ottawa, Ontario for the rental of photo booth equipment. “The equipment” refers to any items rented and delivered by the owner to the client. KASA Photo Booth remains the sole owner of all its rental equipment.

  2. BOOKING AND PAYMENT: 
    2.1 A non-refundable deposit of $100 is required to secure your booking. 

    2.2 The remaining balance must be paid 24 hours before the delivery of the equipment. 

    2.3 The client agrees to pay in full the rental fees detailed in prior communication including the delivery fee (if applicable). 

    2.4 If the client fails to pay, the owner reserves the right to render the rental agreement void and will not deliver the equipment.

    2.5 All prices are in CAD, the fees are for the duration of your event. Set-up and take-down is included.

    2.6 Payments can be made via credit card, bank transfer, cash or other agreed methods.

  3. EQUIPMENT AND SETUP:
    3.1 Our team will arrive at the venue at least 1 hour before the rental period to set up the photo booth. 

    3.2 The client must provide adequate space and access for the booth and must ensure that the setup area is free from obstacles.

    3.3 The Client agrees to use the photobooth equipment solely for its intended purpose.

    3.4 The Client shall not tamper with, modify, or attempt to repair the equipment without the Company's consent.

  4. CANCELLATION POLICY: 
    4.1 In the event of cancellation by the Client, the deposit shall be forfeited to cover administrative costs and lost opportunities.

  5. LIABILITY: 
    5.1 The client and the owner agree to examine all the equipment at the time of delivery to ensure all the items are in good condition. Our setup team will take photographs and/or video of the equipment at the time of delivery. 

    5.2 The Client acknowledges that they are responsible for any damages caused to the photobooth equipment during the rental period.

    5.3 In case of damages to the photobooth equipment, the Client agrees to compensate the Company for repair or replacement costs up to a maximum liability of $10,000 (ten thousand dollars).

    5.4 The Client agrees to promptly notify the Company in the event of any damages to the equipment.

    5.5 The Client acknowledges that the owner is not responsible for the client’s failure to follow the instructions or recommendations.

  6. DELIVERY/PICK-UP:
    6.1 A delivery fee may apply depending on the location within Ottawa and Surrounding Areas. If applicable, this fee is included in the quote.

    6.2 The owner will not be held responsible for late deliveries due to extreme weather conditions, but the client will be notified in the case of an unlikely event.

    6.3 The owner will arrive approximately 1 hour before your event starts to set-up the equipment, and pick it up at the time specified in this agreement, it will take approximately 1 hour for take-down.

    6.4 The client agrees to have the equipment ready for pick-up at the time specified in this agreement.

  7. INDEMNIFICATION/ LIABILITY WAIVER:
    7.1 By accepting and using the equipment, the client and any user acknowledge that the equipment is being used at their own risk. The owner will not be responsible for accidents, injuries or damages caused directly or indirectly by the use or misuse of the equipment.

    7.2 The client agrees to relieve the owner of all liability for loss, damage or injury associated with the use of the equipment from any cause whatsoever, including negligence.

    7.3 The client and any user agree to hold harmless the owner, from any liability for injury, death, property loss or damage which may result directly or indirectly from the use of the rental equipment and from missing or inappropriate parts of the rental equipment including all liability which may result from acts of the owner.

    7.4 The client agrees to indemnify the owner for any loss, damage and costs, as well as those which may result from claim or lawsuit for personal injury, death, property loss or damages related in any way to the use of the equipment. 

  8. FORCE MAJEURE: 
    We are not liable for any failure to perform our obligations due to events beyond our control, including but not limited to natural disasters, strikes, or governmental actions.

  9. AMENDMENTS: 
    We reserve the right to amend these terms and conditions at any time. Clients will be notified of any changes.

  10. GOVERNING LAW: 
    These terms and conditions shall be governed by and construed in accordance with the laws of Ontario, Canada.
